Attorney-client privilege is a cornerstone of the legal system that ensures confidential communication between a lawyer and their client. It promotes trust, enabling effective legal representation and upholding the client's fundamental right to fair trial under Article 21 of the Constitution.

Recently, the Supreme Court barred police and prosecuting agencies from summoning lawyers to reveal client communications, reaffirming the sanctity of this privilege under Section 132 of the Bharatiya Sakshya Adhiniyam (BSA), 2023.

The Court clarified that:

  1. The privilege protects the client's right to representation, not lawyer immunity.
  2. Summons to lawyers must be justified with facts and approved by a Superintendent of Police or higher authority.
  3. Exceptions exist when the communication is for an illegal purpose or if the lawyer observes a crime being committed.

The ruling balances investigative powers with judicial oversight, as provided under Section 528 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), ensuring accountability while preventing harassment of legal professionals. Constitutionally, it safeguards rights under Articles 19(1)(g) (freedom to practice any profession), 21 (protection of life and liberty), and echoes Article 20(3) (protection against self-incrimination).
