Demand of the Question

  • Why the right to peaceful assembly matters in Indian democracy
  • What reasonable restrictions can be placed on peaceful assembly

What you wrote:

Article 19(1)(b) of Indian constitution deals with the right to assemble peacefully without arms. But the recent detention of Youth protestors in Jantar Mandir leads to sparking discussion of the right itself.

Article 19(1)(b) of Indian constitution deals with the right to assemble peacefully without arms. But the recent detention of Youth protestors in Jantar Mandir leads to sparking discussion of the right itself.

Suggestions to improve:

  • Retain Article 19(1)(b), but add a short explanation of how peaceful assembly allows citizens to express collective concerns.
  • You could shorten the detention reference and use it only to introduce the balance between the right and lawful restrictions.

What you wrote:

Importance of Right to Peacefull Assembly-
1. Safety valve : Act as an inskumbent for dissent and citizen voice between elections
2. Assembly act as the democratic cheque backed by - Himat Lal K. shah: barred arbitary police bans on public meeting
3 enabling collective bargaining for marginalised workers and groups who lack lobbying power
4. Matching global standards under ICCPR article 21
5. Building social accountability by testing policy legitimacy out in open rather than behind close door.
6. Align with the vision of constitutional makers.

Suggestions to improve:

  • After the Himmat Lal K. Shah reference, explain that protection against arbitrary police bans helps citizens question those in power. Briefly identify the case as concerning police control over public meetings.
  • Replace the broad “constitutional makers” point with a clear link to participatory democracy or equal political voice.
  • Combine the international reference with the constitutional context, leaving more space for explaining your stronger points on dissent, inclusion and accountability.

2. Preventive orders under sec 163 BNSS must pass the Anuradha Basin and Ramlila Maidan test of proportionality and imminent threat.
3. Blanket bans are illegal, and state action must balance the right to protest with local resident's peace.

Suggestions to improve:

  • Correct the Mazdoor Kisan Shakti Sangathan judgment year and retain its useful protest-rights versus residents’ peace connection.
  • Below the flowchart, explain that restrictions must have a legal basis, relate to the permitted grounds and be proportionate. A restriction should not go further than necessary to address the concern.
  • Add a short distinction: Article 19(1)(b) protects peaceful, unarmed assembly in the first place; Article 19(3) permits reasonable restrictions on that protected activity.

What you wrote:

Challenges regards to 19(1)(b) -
1. Misuse of preventive powers, when sec 163 BNSS get clamped routinely
Eg: Jantar Mandir protest - Newdelhi 2020 Oct 10
2. Conflict between protest sites and daily life
> Indefinite blockades of public roads.
> Chocking commuter movement and business.
Way forward
1. Citizen engagement in assembly abiding with constitutional morality
2. Institutionalising designated protest spaces with clear standard operating proceduring.
3. Mandating strict use of proportionaley test.

3. Mandating strict use of proportionaley test.

Suggestions to improve:

  • Explain the preventive-power concern through a clear mechanism: routine restrictions without assessing the specific risk can unnecessarily limit peaceful participation.
  • Make the designated-space proposal practical by linking clear standard operating procedures to transparent permissions, usable venues and limited disruption to daily life.
  • Compress this section into a few bullets and connect each reform directly to protecting assembly while maintaining public order.

What you wrote:

The balance between public order and civic protest is what protects both rule of law and active citizen participation.

The balance between public order and civic protest is what protects both rule of law and active citizen participation.

Suggestions to improve:

  • Retain the balanced tone, but clarify that public-order concerns justify only lawful, proportionate restrictions.
  • End by reaffirming protection for peaceful dissent alongside responsibility towards other citizens.

What works: Your answer covers both demands and uses strong ideas on dissent, marginalised groups, accountability and competing public interests.Revision priorities: Correct the protest-site name and judgment year, explain the test of reasonable restrictions, and shorten broad challenge-and-reform points to give the central legal discussion more depth.
