The right to peaceful assembly is a fundamental right in India. Discuss its importance and the reasonable restrictions that can be imposed on it.

Article 19(1)(b) guarantees citizens the right to assemble peacefully and without arms. Recent restrictions on public demonstrations have renewed debates over balancing democratic dissent with public order.

Importance of the Right to Peaceful Assembly

  1. Democratic participation enables citizens to express collective demands. e.g: Peaceful public demonstrations.
  2. Freedom of expression allows citizens to communicate grievances collectively. e.g: Article 19(1)(a).
  3. Government accountability enables people to question public policies and decisions.
  4. Protection of minorities gives marginalised communities a platform to voice concerns.
  5. Participatory democracy encourages public engagement beyond elections.
  6. Social reform enables collective mobilisation against injustice. e.g: Gandhian Satyagraha movements.

Reasonable Restrictions on Peaceful Assembly

  1. Constitutional limits permit restrictions for public order and national sovereignty. e.g: Article 19(3).
  2. Public safety requires preventing violence and threats to citizens.
  3. Traffic regulation protects the movement of other citizens. e.g: Shaheen Bagh judgment, 2020.
  4. Time and place restrictions help balance competing public interests. e.g: Mazdoor Kisan Shakti Sangathan case, 2018.
  5. Preventive measures may address serious threats to public order. e.g: Section 163 of BNSS.

Way Forward

  1. Ensure restrictions satisfy legality, necessity and proportionality.
  2. Provide accessible and suitable spaces for peaceful demonstrations.
  3. Strengthen transparent permissions and judicial oversight of restrictions.

Peaceful assembly is essential to democratic dissent. The State must protect this freedom while ensuring proportionate restrictions that safeguard public order and the rights of others.
