Discuss the constitutional position, powers, and functions of the Lieutenant Governor in Union Territories with special reference to Delhi.

Union Territories (UTs) in India are administered by the President through an Administrator or Lieutenant Governor (LG) under Article 239 of the Constitution of India. However, the National Capital Territory of Delhi has a unique constitutional arrangement due to its political and administrative importance. Through Article 239AA of the Constitution of India, Delhi was granted a legislative assembly and council of ministers, while the LG continues to act as the representative of the Union government.

Constitutional Position of the Lieutenant Governor

The LG occupies a dual role in Delhi’s governance structure:

Representative of the President: The LG administers the Union Territory on behalf of the President and ensures that national interests are protected in the capital.

Part of the Local Executive Structure: Unlike most UTs, Delhi has an elected government. The LG works with the Council of Ministers headed by the Chief Minister, similar to the Governor–State government relationship.

Special Constitutional Status of Delhi: Article 239AA created a hybrid administrative model where both the Union government and the elected government share responsibilities.

Powers and Functions of the Lieutenant Governor

  1. Executive Powers

The LG acts as the administrative head of the National Capital Territory.

He/she exercises executive authority in the name of the President.

The LG works with the Council of Ministers but may refer disagreements to the President.

  1. Legislative Powers

The LG summons, prorogues, and can dissolve the Legislative Assembly on the advice of the Chief Minister.

Bills passed by the Assembly may be reserved by the LG for consideration of the President.

Ordinances may be promulgated by the LG when the Assembly is not in session.

  1. Discretionary Powers

The LG has discretionary powers in matters where the Constitution requires him/her to act independently.

In case of differences between the LG and the elected government, the LG may refer the matter to the President.

  1. Control over Reserved Subjects

Under Article 239AA, the Delhi Legislative Assembly cannot legislate on certain subjects, including:

Public Order

Police

Land

These subjects remain under the direct control of the Union government and the LG.

Issues and Institutional Tensions

Delhi’s governance structure has often led to conflicts between the LG and the elected government. The Government of NCT of Delhi v. Union of India clarified that:

The LG is bound by the aid and advice of the Council of Ministers in matters where the Assembly has legislative competence.

The LG should not act as an obstructionist authority but as a facilitator of governance.

This judgment emphasized the principles of cooperative federalism and constitutional morality.

Conclusion

The Lieutenant Governor plays a crucial role in maintaining the balance between Union control and democratic governance in Delhi. While the LG ensures that national interests are protected in the capital, effective governance requires coordination and cooperation between the LG and the elected government. Strengthening institutional harmony is essential for the smooth administration of the National Capital Territory.
