"Birthright citizenship reflects the balance between constitutional guarantees and sovereign control over immigration." Examine this statement with reference to the recent U.S. Supreme Court judgment upholding birthright citizenship and discuss its relevance in the Indian constitutional framework.

The U.S. Supreme Court recently reaffirmed birthright citizenship under the Fourteenth Amendment by striking down attempts to restrict citizenship through executive action. The judgment revives the debate on whether citizenship should primarily rest on constitutional rights or sovereign control over migration.

Constitutional basis of birthright citizenship

  1. Citizenship as a constitutional guarantee – The U.S. Constitution follows the principle of jus soli, treating birth within the territory as the primary basis of citizenship under the Fourteenth Amendment. e.g.: United States v. Wong Kim Ark (1898).
  2. Executive power is constitutionally limited – The Court held that executive orders cannot override an explicit constitutional guarantee of citizenship.
