"Respect for national symbols strengthens national unity, but constitutional democracies must also safeguard individual freedoms." Examine this statement in the context of legal protection for national symbols in India.

Parliament's passage of the Prevention of Insults to National Honour (Amendment) Bill, 2026, extending statutory protection to Vande Mataram, has revived the debate on balancing national honour with constitutional freedoms in a democratic society.

Need for legal protection of national symbols

  1. Strengthens national unity – National symbols promote a shared identity across India's linguistic, religious and cultural diversity.
  2. Honours the freedom struggle – Vande Mataram occupies a significant place in India's anti-colonial movement. e.g.: Adopted as the National Song by the Constituent Assembly.
  3. Promotes constitutional patriotism – Respect for national symbols reinforces citizens' commitment to constitutional values.
  4. Protects national dignity – Legal safeguards deter deliberate acts intended to provoke social discord or insult national identity.
  5. Promotes civic responsibility – Respecting national symbols encourages responsible citizenship and democratic participation.
  6. Ensures parity among national symbols – Extending protection to the National Song seeks consistency with existing protection for the National Flag and National Anthem.
  7. Strengthens social cohesion – Shared respect for national symbols can foster emotional integration in a diverse society.

Constitutional concerns

  1. Freedom of expression – Restrictions must remain consistent with Article 19(1)(a) and satisfy the reasonable restrictions under Article 19(2).
  2. Avoiding compelled patriotism – Constitutional patriotism is best nurtured through voluntary respect rather than coercion.

Way Forward

  3. Adopt a balanced constitutional approach – Protect national honour while preserving democratic freedoms and the rule of law.

National symbols embody India's constitutional identity and collective heritage. Their protection is legitimate, but in a constitutional democracy, respect for national honour must coexist with individual liberty, ensuring that patriotism remains both meaningful and constitutional.
